Information obligations within the meaning of the General Data Protection Regulation (GDPR)

Data processing shall be carried out in particular for the purpose of fulfilling a contract with the data subject or for carrying out pre-contractual measures, which are made at the request of the data subject pursuant to Art 6 para 1 lit c GDPR or for the purpose of fulfilling a legal obligation of the data controller within the meaning of Art 6 para 1 lit c GDPR or processing is necessary to safeguard the legitimate interests - including the assertion, exercise or defence of legal claims - of the data controller or a third party pursuant to Art 6 para 1 lit f GDPR. In the case of consent given, processing is carried out on the legal basis of Art 6 para 1 lit a GDPR.
Insofar as the processing is based on Art 6 para 1 lit f GDPR, the legitimate interest of the data controller or its group companies and the other recipients of transmissions consists above all in being able to operate a group-wide customer management system for the purpose of administrative optimisation and simplification and for the purpose of direct marketing (marketing and information measures, in particular regarding the products and services offered by the following group companies).
The following categories of recipients exist within the meaning of Art 13 para 1 lit e GDPR:
- Group companies of the data processor;
- Data processors;
- Product manufacturer (especially for warranty registration);
- Authorities;
- Third-party providers and cooperation partners (e.g. development service providers, credit card providers, banks);
- Collection service providers, legal and tax advisors and experts for asserting, exercising or defending legal claims;
- auditing companies for the fulfilment of accounting obligations;
- Courts for asserting, exercising or defending legal claims
- Conciliation bodies (such as the European Commission's online stratification body).

the personal data will be stored for as long as it is necessary for the purposes of
- performance of a contract with the data subject, or
- fulfilment of a legal obligation (e.g. 7-year retention periods within the meaning of the UGB, BAO) or
- assertion, exercise or defence of legal claims is necessary.

According to the GDPR, the following rights of data subjects exist with the exceptions provided for in the respective provisions:
- Right of access (Art 15 GDPR),
- Right to rectification (Art 16 GDPR),
- Right to erasure (Art 17 GDPR),
- Right to restriction of processing (Art 18 GDPR),
- Right to object (Art 21 GDPR),
- Right to data portability (Art 20 GDPR),
- Right lodge a complaint to the supervisory authorities (Art 77 GDPR, in particular the Austrian data protection authority),
- Right to revoke consent (Art 7 para 3 GDPR), if the processing is based on consent, with effect for the future.

The provision of personal data is required by law or is based on a contractual obligation, so that the data subject is obliged to provide it and failure to provide it would result in the refusal of the business relationship.

If data is not collected from the data subject itself, the following additional categories of personal data are collected from publicly accessible databases (e.g. land register, commercial register, edicts file, central register of residents):
- Commercial register data
- creditworthiness data including data on payment behaviour (e.g. KSV queries)
- Insolvency data
- Reported financial data

If personal data are processed in accordance with Art 21 para 2 GDPR, the data subject has the right to object at any time to the processing of personal data concerning him/her. In the event of such objection, the personal data will no longer be processed.
